What this document is

WP.28 (Thai: BT.28) is a foreigner’s application to the Department of Employment (DOE), Ministry of Labour, for a work permit or for the renewal of a current one. It is intended for foreigners under Section 63/2 of the Royal Ordinance on Managing the Work of Foreigners B.E. 2560 (2017), as amended.

Section 63/2 covers foreigners whom the Minister, under the immigration law, has permitted to stay in Thailand or has exempted from that law (other than the categories of Section 63/1), where the Cabinet has allowed them to work. The Cabinet may also limit the types of work they are allowed to do.

The form is bilingual (Thai and English) and has 4 pages: applicant details, address in Thailand, the document showing permission to stay, previous work permits, the work and the employer, the period applied for and a checklist of attached documents. The last page is for official use.

Who files it and where

  • a foreigner staying in Thailand under a special permission of the Minister under the immigration law (or exempted from it), whose category the Cabinet has allowed to work;
  • other cases have their own forms: for example, a regular permit under Section 59 uses form WP.25, and Section 63/1 uses form WP.27;
  • the application goes to the Department of Employment: in Bangkok, the office for foreign workers or an area employment office; in other provinces, the provincial employment office; check the exact address on the DOE website;
  • check the fee, processing time and whether a representative may file for you with the office.

What the form asks for

  • type of application — first permit or renewal;
  • title, name, nationality, date of birth, age, address in Thailand, phone, fax, e-mail;
  • passport or document in lieu of passport, visa (if any), date and checkpoint of arrival, permitted stay;
  • previous work permit (first application) or current one (renewal);
  • type and nature of work, employer and its address, place of work, period applied for;
  • ticks for the attached documents (section 4), date and signature.

Documents attached (section 4 of the form)

  • copy of the passport or document in lieu of passport;
  • copy of the proof of permission to stay in Thailand;
  • Employment Certification Form from the employer stating why a Thai national is not employed;
  • medical certificate from a licensed physician (no mental disorder and no prohibited diseases);
  • three 3×4 cm photos — first application only;
  • copy of the employment contract;
  • the work permit — renewal only;
  • employer documents: for a natural person, a copy of the ID card, passport or Certificate of Residence and, if any, the business licence; for a company, a copy of its registration certificate showing the business category.

The office may ask for more documents. Check in advance whether the office accepts a form completed in Latin letters.
