What this document is
WP.45 (บต.45) is a foreigner’s request to the Department of Employment (DOE), Ministry of Labour, to change particulars of a work permit when the type of work is changed or a type of work is added under Category 2 or Category 3 appended to the Ministry of Labour notification on work prohibited for foreigners dated 1 April 2020.
Under that notification, Category 2 covers work that foreigners may do only under international agreements or obligations of Thailand, and Category 3 covers work that foreigners may do only with an employer. Check with DOE which category your work belongs to.
The form is bilingual (Thai and English) and has 3 pages: details of the foreigner and the current work permit, employer and place of work, the requested change, the checklist of attachments, the signature and a section for official use only.
Who files it and where
- a foreigner holding a Thai work permit whose type of work under Category 2 or 3 changes or needs to be added;
- the form is submitted to the Department of Employment — in Bangkok the DOE office for foreign workers or an area employment office, in other provinces the provincial employment office; check with DOE which office handles your permit;
- the fee and processing time are not stated on the form — check them with the office.
What the form asks for
- title, name, nationality, type of foreigner and the 13-digit foreigner ID (if any);
- work permit number, province, date of issue and expiry;
- address in Thailand, telephone, fax and e-mail;
- whether the employer is the same as in the work permit or new, employer name and address, place of work;
- the change requested under Category 2 and/or Category 3 — change from one type of work to another, or add a type of work; for Category 2 the professional licence details if the work requires one;
- other changes to the permit, if any, and the reason; date of signing.
Documents to attach (checklist in section 4)
- a copy of the foreigner’s identity document (usually the passport);
- a copy of the professional licence or certificate, if the work legally requires one;
- the work permit;
- two 3×4 cm photographs;
- copies of documents proving that the change actually took place;
- employer documents: for a natural person — a copy of the identity document and, if any, of the business licence; for a juristic person — a copy of the registration certificate showing the business category.
The office may ask for additional documents — check with it before submitting.
