What this document is

Form แบบ บต.54 is an official form of the Thai Department of Employment (กรมการจัดหางาน). With it the employer notifies the registrar that they did not accept foreign workers brought in by a licensed recruitment agency (บริษัทนำคนต่างด้าวมาทำงานในประเทศ), or that the workers themselves did not consent to work.

The legal basis is Section 50, paragraph one, items (1) and (2), as stated in the form title. The form is in Thai and has two pages: page 1 holds the employer, the agency and a table of workers (up to 8); the back lists the supporting documents and has the officer’s notes.

Who files it and where

  • the employer — an individual or a company to whom the agency handed over the foreign workers;
  • it is filed with the registrar (นายทะเบียน) at the Department of Employment office — provincial or Bangkok area office for the employer’s location; check with the office which branch accepts your notification;
  • the employer may file in person or through a representative with a power of attorney;
  • the form states no deadline or fee — check them with the Employment Office.

What the form asks for

  • date of the notification (Buddhist Era year, พ.ศ.);
  • employer's name, Thai ID card number or juristic person registration number, type of business;
  • employer's address and phone;
  • name of the recruitment agency and the date it handed over the workers;
  • the reason: the employer does not accept the workers, or the workers do not consent to work;
  • table of workers: name, nationality, work permit number, passport number, date and reason;
  • employer's signature and date.

Documents usually attached

  • if the employer files in person: Thai ID card (the officer makes the copy); for a juristic person — a copy of the juristic person registration certificate;
  • if a representative files: a power of attorney with duty stamps, a copy of the grantor's ID card and the grantee's ID card (the officer makes the copy), or other documents the office requires.
