What this document is

หนังสือมอบอำนาจ (ท.ด. 21) is the standard power of attorney form of Thailand’s Department of Lands (กรมที่ดิน). This version has the subject “อายัด” printed on it — seizure (attachment) of a land plot: at the request of an interested person the Land Office temporarily blocks registrations on the plot. With this form the principal authorises an agent to file that request on his or her behalf.

The printed powers: file a request to seize the plot described at the top of the form and give statements to the officer. The land is described as shown on the title deed (โฉนด), and the form is filled in in Thai.

Section 83 of the Thai Land Code allows a seizure at the request of a person who has an interest in the land and could sue to have a right registered or a record changed; the seizure is temporary. Who takes part

  • the principal — the person requesting the seizure (ผู้มอบอำนาจ), e.g. a buyer under a contract or a creditor; usually not the registered owner;
  • the agent — the person who files the request at the Land Office (ผู้รับมอบอำนาจ);
  • two witnesses who certify the principal’s signature or fingerprint.

The landowner does not sign this power of attorney.

What the form asks for

  • place and date (year in the Buddhist Era, พ.ศ.);
  • land details from the โฉนด title deed: map sheet, land number, survey page, deed number, sub-district, district, province;
  • name, Thai ID number, age, race, nationality, parents’ names, address and phone of the principal and of the agent;
  • additional powers, if any (optional);
  • signatures of the principal and two witnesses — by hand.

Documents usually attached

  • evidence of the principal’s claim to the land (for example, a contract);
  • copies of the principal’s ID card and house registration (or passport), signed by the principal;
  • the agent’s ID card or passport;
  • a copy of the title deed or the land details, if available.
