What this document is

This is the standard power of attorney of Thailand's Department of Lands (กรมที่ดิน) — form T.D. 21 (ท.ด. 21) with the printed subject «ภาระจำยอมบางส่วน»: a servitude over part of the land. The owner of a plot with a title deed (chanote, โฉนดที่ดิน) uses it to have a representative register the servitude at the land office instead of going in person.

The form is one page and in Thai only. The authority text is printed: register part of the plot as the servient land (ภารยทรัพย์) for a stated purpose, in favour of the plot with a stated title deed number in the same sub-district and district, as a walkway of a stated width running from one side to another — either along the whole plot or as shown on an attached sketch map — with or without compensation, and give statements to the land officer.

Who fills it in and where it is filed

  • the grantor — the owner of the plot that will carry the servitude;
  • the attorney — the person who goes to the land office on the grantor's behalf; this can also be the owner of the neighbouring plot or their representative (then a consent sentence is added);
  • the power of attorney is presented at the land office (สำนักงานที่ดิน) where the plot is located when the servitude is registered.

What the form asks for

  • plot details from the chanote: map sheet (ระวาง), land number, survey page, deed number, sub-district, district, province;
  • place and date (year in the Buddhist Era, พ.ศ.);
  • grantor and attorney: name in Thai script, Thai ID number, age, race (เชื้อชาติ), nationality, parents' names, registered address, phone;
  • the servitude: its purpose, the title deed number of the benefiting plot, the width of the passage in metres, from which side and towards which side it runs, whether it covers the full length of the plot or follows a sketch map;
  • compensation: with or without, and the amount in figures and in words;
  • handwritten signatures of the grantor and two witnesses.

Documents usually needed

  • the original chanote of the plot that carries the servitude;
  • copies of the grantor's and attorney's ID cards and house registrations, signed as true copies;
  • a sketch map of the servitude strip, if the form refers to an attached map;
  • the documents of the neighbouring plot and its owner, as requested by the land office.

What is this power of attorney for?

How is it different from the power of attorney for a servitude?

This form has the printed subject «ภาระจำยอมบางส่วน» — the servitude burdens only part of the plot, a strip of a stated width. The Department of Lands has a separate form with the subject «ภาระจำยอม».

In which language is it filled in?

The form is in Thai only: names, addresses, the plot location, the purpose of the servitude and the directions are written in Thai script; the year is in the Buddhist Era.

What if the strip does not run along the whole plot?

Choose the option «as per the attached sketch map» and attach a sketch map of the strip to the power of attorney.

Can the attorney be the owner of the neighbouring plot?

Yes, the form allows it. In that case the consent sentence printed in the remark is added, so the attorney acts both in their own name and as the other party's representative.

Are witnesses needed?

Yes, the form has lines for two witnesses who certify the grantor's signature or fingerprint. The signatures are handwritten.
