What this document is

หนังสือมอบอำนาจ (ท.ด. 21) is the standard power of attorney form of Thailand’s Department of Lands (กรมที่ดิน). This version has the subject “ขอใบแทนโฉนดที่ดิน” printed on it — a request for a replacement (ใบแทน) of a land title deed (โฉนด) when the owner’s copy is damaged or lost. With it the landowner (principal) authorises another person (agent) to handle this on his or her behalf.

The printed powers: applying for a replacement title deed for this plot, collecting it and giving statements to the officer. The form marks what happened to the deed — “ชำรุด” (damaged) or “สูญหาย” (lost); if it was lost, the police station and the police daily log entry number of the loss report are stated. The form is filled in in Thai.

Who takes part

  • the principal — the landowner named on the title deed (ผู้มอบอำนาจ);
  • the agent — the person who files the application and collects the replacement at the Land Office (ผู้รับมอบอำนาจ);
  • two witnesses who certify the principal’s signature or fingerprint.

What the form asks for

  • place and date (year in the Buddhist Era, พ.ศ.);
  • land details from the title deed: map sheet, land number, survey page, deed number, sub-district, district, province;
  • name, Thai ID number, age, race, nationality, parents’ names, address and phone of the principal and of the agent;
  • whether the deed is damaged or lost; if lost — the police station and the daily log entry number (บันทึกประจำวัน);
  • additional powers, if any (optional);
  • signatures of the principal and two witnesses — by hand.

Documents usually attached

  • the damaged title deed — if it is damaged;
  • the police report of the loss (บันทึกประจำวัน) — if the deed is lost;
  • copies of the principal’s ID card and house registration, signed by the principal;
  • the agent’s ID card or passport.

The exact list, the fees and when the replacement is issued are not stated on the form — check with the Land Office (สำนักงานที่ดิน) where the land is registered.
