āļŦāļāļąāļāļŠāļ·āļāļĄāļāļāļāļģāļāļēāļ (āļ.āļ. 21) is the standard power of attorney of the Thai Department of Lands (āļāļĢāļĄāļāļĩāđāļāļīāļ). In this version the subject âāđāļāļāļāļēāļĄāļāļģāļŠāļąāđāļāļĻāļēāļĨâ â transfer by court order â is pre-printed. With it, the principal, in whose name the court ordered the land to be registered, authorises an agent to register the transfer of the plot (with any building, if applicable) at the Land Office, make statements to the officer and act until registration is complete.
The form takes the land details from the title deed (āđāļāļāļ): map sheet, parcel number, survey page, title deed number, tambon, amphoe and province. The powers text names the court, the âblackâ and âredâ case numbers and the date of the judgment. The form is filled in Thai, with years in the Buddhist Era (āļ.āļĻ.).
Who is involved
- the principal â the person in whose favour the court judgment was given (āļāļđāđāļĄāļāļāļāļģāļāļēāļ);
- the agent â the person who goes to the Land Office (āļāļđāđāļĢāļąāļāļĄāļāļāļāļģāļāļēāļ);
- two witnesses who certify the principalâs signature or fingerprint.
If the agent is the other party to the case or represents them, the note on the form requires adding consent that the agent acts both in his or her own name and on behalf of the other party.
What the form asks for
- place and date (Buddhist Era year, āļ.āļĻ.);
- land details from the āđāļāļāļ title deed;
- name, age, ethnicity, nationality, parentsâ names, address and phone of the principal and the agent;
- any building on the land (house, building or shophouse, floors, house number) â if it passes with the land;
- the court, the âblackâ and âredâ case numbers and the judgment date;
- Thai ID numbers and signatures of the principal and two witnesses â by hand.
What is usually attached
- the original title deed (āđāļāļāļāļāļĩāđāļāļīāļ), if the applicant holds it;
- a certified copy of the court judgment and, as a rule, a certificate that it is final (āļāļģāļĢāļąāļāļĢāļāļāļāļāļĩāļāļķāļāļāļĩāđāļŠāļļāļ);
- copies of the principalâs ID card and house registration, signed;
- the agentâs ID card or passport.
The form does not list the exact documents, fees, taxes or timelines â check with the Land Office (āļŠāļģāļāļąāļāļāļēāļāļāļĩāđāļāļīāļ) where the land is registered. Foreignersâ right to own land in Thailand is restricted by law â check this in advance.
