What this document is

สัญญาจ้างแรงงาน (Employment Contract, កិច្ចសន្យាការងារ) is the standard employment contract of the Department of Employment (DOE), Ministry of Labour of Thailand, for hiring Cambodian nationals under the government-to-government Memorandum of Understanding (MOU) on employment.

The contract has 5 pages in three languages: Thai on the left, English and Khmer on the right; all three texts are equally authentic. It is made in duplicate — one copy for the employer and one for the employee.

Who fills it in and where it goes

  • the parties are the employer in Thailand (a company or an individual) and the Cambodian employee; both sign, together with two witnesses;
  • the contract is usually part of the document set for bringing in workers under the MOU, together with the employer's request and other papers required by the Department of Employment;

  • working hours per day and working days per week, weekly days off, public holidays and annual leave;
  • overtime and holiday work rates;
  • the other terms (food, accommodation, medical treatment, travel, obligations, termination) are printed on the form; the names of the parties are printed under the signatures; witnesses write theirs by hand.

Documents usually needed

  • company registration certificate, or the ID card of an individual employer;
  • the employee's passport or document in lieu of passport;
  • the documents the Department of Employment requires for an MOU worker request.
