What this document is
Form T.D. 21 (ท.ด.21) is the standard power of attorney of the Thai Department of Lands (กรมที่ดิน). This version has the subject “lease of land for … years” (เช่าที่ดินมีกำหนด … ปี) printed on it: the grantor — the lessee — authorises the attorney to lease the whole plot shown at the top of the form on the terms written into the power of attorney and to give statements to the land officer until registration is complete.
The power of attorney states the lease term in years, the start and end dates, the total rent, the amount and frequency of payments (monthly or yearly) and the day by which rent is due. The form is one page in Thai; the plot is identified by its title deed (โฉนดที่ดิน).
Who fills it in and where it is used
- the grantor (ผู้มอบอำนาจ) — the lessee who cannot attend the land office in person;
- the attorney (ผู้รับมอบอำนาจ) — the person who will register the lease on the lessee’s behalf;
- the power of attorney is filed at the land office (สำนักงานที่ดิน) responsible for the plot;
- under the Thai Civil and Commercial Code, a lease of immovable property for more than three years must be in writing and registered, otherwise it is enforceable for three years only (s. 538); the maximum term is 30 years (s. 540);
- foreigners can generally lease land even though they generally cannot own it; check the specific requirements with the land office.
What the form asks for
- the title deed details of the plot and its tambon, amphoe and province;
- the place and date of signing (year in the Buddhist calendar, พ.ศ.);
- for the grantor and the attorney: name, Thai ID, age, ethnicity, nationality, parents’ names, address and phone;
- buildings, if leased together with the land (house, building or shophouse, floors, number, house number);
- the lease term, start and end dates, the total rent and the rent per period in figures and in words, and the payment due day;
- handwritten signatures of the grantor and two witnesses.
What is usually attached
- copies of the ID cards (a passport for a foreigner) and house registration books of the grantor and the attorney;
- the lease agreement and any land documents the land office requests.
The form itself does not list attachments, fees or duties — check them with the land office responsible for the plot.
