What this document is

This is the standard power of attorney of Thailand's Department of Lands (กรมที่ดิน) — form T.D. 21 (ท.ด. 21) with the printed subject «แบ่งขายที่ดิน»: subdivision of land for sale. The owner of a plot with a title deed (chanote, โฉนดที่ดิน) uses it to split off part of the land and sell it to a buyer through a representative instead of in person.

The form is one page and in Thai only. The text of the authority is already printed: the attorney applies for a subdivision survey for sale to the named buyer, brings the surveyor, places boundary markers and certifies the boundaries, consents to correcting the map or area if the survey differs, amends the application if needed, registers the subdivision and sale, pays and collects back the remaining survey deposit, receives the title deed and gives statements to the land officer.

Who fills it in and where it is filed

  • the grantor — the owner of the plot from which the portion for sale is split off;
  • the attorney — the person who acts at the land office on the grantor's behalf;
  • the buyer of the new portion is named in the text of the authority;
  • the power of attorney is presented at the land office (สำนักงานที่ดิน) where the plot is located;
  • as a general rule foreigners cannot acquire land in Thailand — check the buyer's eligibility with the land office.

What the form asks for

  • plot details from the chanote: map sheet (ระวาง), land number, survey page, deed number, sub-district, district, province;
  • place and date (year in the Buddhist Era, พ.ศ.);
  • grantor and attorney: name in Thai script, Thai ID number, age, race (เชื้อชาติ), nationality, parents' names, registered address, phone;
  • title and name of the buyer of the subdivided portion;
  • additional powers, if needed;
  • handwritten signatures of the grantor and two witnesses.

The price, area and boundaries of the portion are not on the form: they are set by the survey and by the transaction documents at the land office.

Documents usually required

  • the original chanote of the plot;
  • copies of the ID cards and house registrations of the grantor and the attorney (signed as true copies);
  • the buyer's documents for registering the sale.

The form does not list the full set of documents, fees, the survey deposit or processing times — check them with the land office. The form refers to a warning on the back; the official file has no back page.

How is it different from the power of attorney to sell a whole plot or a share?

This form has the printed subject «แบ่งขายที่ดิน»: the plot is first divided by survey and the new portion is sold. The Department of Lands has separate forms for selling a whole plot («ขายที่ดิน») and a co-owner's share («ขายที่ดินเฉพาะส่วน»).

In which language is it filled in?

The form is in Thai only: names, addresses and the plot location are written in Thai script as on the ID card, house registration and chanote; the year is in the Buddhist Era.

Where are the price and area of the portion stated?

Not in this power of attorney — the form has no such fields. The survey sets the area and boundaries, and the price goes into the transaction documents when the sale is registered at the land office.

Can the attorney be the buyer?

The form allows it. In that case the consent sentence printed in the note is added, so the attorney acts both in their own name and as the representative of the other party.

Are witnesses needed?

Yes, the form has lines for two witnesses who confirm the grantor's signature or thumbprint. They sign by hand.

How much do the survey and registration cost and how long do they take?

The form does not say. Check the survey deposit, fees, taxes and timing with the land office where the plot is located.
